Terms of Service

1. The Service and Your Account

Track Anything is a personal journaling and tracking application.

You are responsible for maintaining the security of your account and devices and for activity performed through your account. Information you provide must be accurate, and you may not use another person's account without permission.

2. License and Acceptable Use

Subject to these Terms and the rules of the platform from which you obtained Track Anything, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the application on supported devices that you own or control. Permitted family sharing or similar storefront features remain subject to the applicable storefront rules.

Track Anything and its software, design, branding, and other materials are licensed, not sold. We and our licensors retain all rights not expressly granted. Except where applicable law does not allow a restriction, you may not:

• copy, sell, rent, lease, sublicense, distribute, or commercially exploit the application;
• reverse engineer, decompile, or attempt to derive its source code;
• bypass access, subscription, usage, or security controls;
• interfere with the application, its infrastructure, or another user's access;
• use Track Anything to violate law, infringe rights, distribute malicious code, or facilitate harmful or fraudulent activity.

3. Your Content

You retain ownership of journals, entries, files, prompts, and other content you provide ("Your Content"). You grant us a limited, non-exclusive license to host, store, reproduce, transmit, format, and otherwise process Your Content only as reasonably necessary to operate the service.

You are responsible for Your Content and for having the rights and permissions needed to store or transmit it. Do not use Track Anything for content that is unlawful, infringes another person's rights, or compromises the security or operation of the Service.

4. AI Services

When you initiate an AI operation, content from the journals or inputs you select may be transmitted to the AI provider you configured. That provider's terms and privacy policy apply to its processing. Do not submit information you are not authorized to share.

Assistant connections. You may grant an assistant access to journals you select. While the connection exists, that assistant can read those journals on its own request; it cannot write to them. You can change or end the connection in the app at any time. The assistant provider's terms and privacy policy apply to its processing.

AI output may be inaccurate, incomplete, outdated, offensive, or unsuitable for your circumstances. You must independently review output before relying on or sharing it. Track Anything and its AI features do not provide medical, psychological, legal, financial, or other professional advice and must not be used as the sole basis for a professional, safety-critical, or high-impact decision.

5. Health and Emergency Disclaimer

Track Anything is intended only for personal organization, journaling, and informational use. It is not designed or intended to diagnose, treat, cure, or prevent a disease or condition and does not provide medical, psychiatric, or healthcare advice. Always consult a qualified professional about a medical or psychological condition.

Track Anything is not an emergency service. If you may harm yourself or someone else, are experiencing suicidal thoughts or self-harm impulses, or have another medical emergency, do not rely on the application. Contact local emergency services or go to the nearest emergency room. In the United States or Canada, call 911 for an emergency. In the United States, call or text 988 for the Suicide & Crisis Lifeline. Outside the United States, local resources may be available through findahelpline.com.

6. Free Access, Trial, and Pro Subscription

Track Anything may offer Free access, a seven-day Pro trial lasting 168 hours from activation, and an auto-renewing annual All Platforms Pro subscription.

The exact price, billing period, taxes, trial terms, and renewal terms shown at checkout control your purchase. Prices may differ by country, currency, storefront, and applicable tax. Unless cancelled before renewal, a subscription renews automatically through the storefront or merchant that billed it. You must cancel through that billing provider; deleting Track Anything or your Track Anything account does not automatically cancel a subscription.

An active All Platforms subscription unlocks Pro on supported platforms when you sign in with the same Track Anything account. A refund, reversal, expiration, or cancellation may remove the related Pro entitlement. Refund eligibility and procedures are described in the Refund Policy and the rules of the billing provider. Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

7. Third-Party Services and Store Terms

Track Anything may interoperate with services supplied by Google, Apple, Microsoft, Dropbox, AI providers, app stores, payment providers, and other third parties. Those services are independent, may change or become unavailable, and are governed by their own terms. You must comply with applicable third-party terms when using Track Anything. We are not responsible for a third party's services, content, security, availability, or independent acts or omissions.

For applications obtained through an Apple App Store, Apple's standard end user license agreement and applicable usage rules apply in addition to these Terms. These Terms are between you and us, not Apple. We, not Apple, are responsible for Track Anything, its maintenance and support, and claims concerning the application to the extent required by law. Apple has no obligation to provide maintenance or support. If the application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the application, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you. You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited or restricted-party list.

For applications obtained through Google Play, these Terms are between you and us, not Google. Google is not responsible for Track Anything or for obligations under these Terms. The Google Play terms and applicable usage rules apply and control to the extent of a conflict with these Terms.

For Web purchases processed by Paddle, Paddle is the merchant of record and authorized reseller. Paddle's Buyer Terms apply to the purchase in addition to these product Terms.

8. Privacy

Our Privacy Policy explains how Track Anything collects, uses, stores, synchronizes, and shares information. It also describes choices and rights that may apply to you. Privacy notices and any consent requested for a specific data practice are separate from acceptance of these Terms.

9. Backups, Availability, and Changes to the Service

Keep independent and current backups appropriate to the importance of Your Content. Removing the application, clearing browser or application storage, losing access to your account, sync conflicts, software defects, service failures, or incorrect use of import, export, backup, or restore functions may cause data to be changed, duplicated, corrupted, or deleted. Verify that important synchronization, export, and restoration operations complete correctly.

We may update, modify, suspend, or discontinue features to maintain or improve Track Anything, address security or legal requirements, or respond to changes in third-party services. Availability and functionality may differ by platform, country, device, account status, or third-party capability. Where required by applicable law, we will provide notice or remedies for a material adverse change.

10. Changes to These Terms

We may update these Terms to reflect changes to Track Anything, our business, third-party requirements, or applicable law. If a change materially affects your rights or obligations, we will present the new version for acceptance before continued use where required. Non-material changes, such as corrections or clarifications that do not affect your rights or obligations, may take effect when posted. The version and effective date identify the Terms that apply.

11. Suspension and Termination

You may stop using Track Anything at any time. You may delete Your Content or account through the available application controls, subject to required retention of limited transaction, security, fraud-prevention, and legal records.

We may suspend or terminate access when reasonably necessary to protect Track Anything, users, or third parties; investigate fraud, payment disputes, security incidents, or unlawful activity; enforce these Terms; or comply with law. Where appropriate, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination remain in effect, including ownership, disclaimers, liability limitations, and dispute terms.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRACK ANYTHING IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM LOSS OR CORRUPTION OF DATA.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW. THESE TERMS DO NOT EXCLUDE ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT LEGALLY BE EXCLUDED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR CONTRIBUTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, OR DATA, ARISING OUT OF OR RELATED TO TRACK ANYTHING OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO TRACK ANYTHING OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR TRACK ANYTHING DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED, INCLUDING WHERE APPLICABLE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY, OR MANDATORY PRODUCT-LIABILITY OR CONSUMER-PROTECTION LAW. The limitations apply even if a remedy fails of its essential purpose and allocate risk between you and us as part of the basis of the agreement.

14. Governing Law and Consumer Rights

German law governs these Terms, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country or state where you reside. Any legally required place of jurisdiction remains unaffected.

15. General Terms

These Terms and the policies and purchase terms expressly referenced in them are the entire agreement between you and us regarding Track Anything, except for terms supplied by an applicable storefront or merchant of record. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or transfer of Track Anything, subject to applicable law.

Except for Apple and its subsidiaries as stated above, these Terms do not create third-party beneficiary rights. Headings are for convenience only.

16. Acceptance

By selecting Accept, you confirm that you have had the opportunity to review these Terms and agree to be bound by it. If you select Decline, you may not use Track Anything.
